MAHARISHI VEDIC CITY

ORDINANCE 2003-2
TO ESTABLISH MAHARISHI VEDIC CITY ORGANIC FARMS
AS A MUNICIPAL DEPARTMENT AND ENTERPRISE OF THE CITY

Adopted April 22, 2003

Whereas, pursuant to the Constitution of the State of Iowa and to Chapter 364 of the Code of Iowa, Vedic City possesses home rule powers, not inconsistent with the laws of the State of Iowa; and

Whereas, if a procedure is not established by state law, a city may determine its own procedures for exercising a particular power; and

Whereas, Chapter 392 of the Code of Iowa provides that an administrative agency may be established by ordinance of the City Council; and

Whereas, the City Council of Vedic City desires to establish an administrative agency, following the procedures set out in Chapter 392;

Now, therefore, it is resolved by the City Council of Vedic City, Iowa, as follows:

Section 1. The city council of Vedic City hereby determines that there is no procedure in state law which governs the establishment of an organic farm as a city enterprise, and the Council determines further that it will follow the procedures set out in Chapter 392 of the Code of Iowa in order to create and establish the Maharishi Vedic City Organic Farms as a home rule city enterprise.

Section 2. Maharishi Vedic City Organic Farms is established as a municipal department and enterprise of Vedic City, Iowa, USA (the “City”) to carry out general corporate purposes of the City as generally described in Section 384.24(4)(f) and (i) of the Code of Iowa. This department is created for the necessary purposes of (i) enhancing the health and welfare of citizens; (ii) supporting economic development; (iii) serving as a model for others including cities and governmental entities, non-profit and for-profit organizations, and individuals; and (iv) supporting programs to create world peace which is a necessity for the well-being of the citizens of the City,

Section 3. Notwithstanding that this activity appears to be exempt from the provisions of Section 23A.2 of the Code of Iowa under Subsection 10(b) thereof, because it carries out general corporate purposes of the City as defined in Section 384.24(4) of the Code of Iowa, pursuant to the provisions of Section 23A.2 of the Code of Iowa, Maharishi Vedic City Organic Farms is hereby authorized but not limited to do the following:

  1. Acquire, purchase, construct, reconstruct, and improve greenhouses and related land and facilities for production of organic produce.
  2. Construct, reconstruct, and improve greenhouses and related facilities for production of organic produce, grow, process, package, advertise, market, ship, distribute, sell and offer for sale to the public and bill for organically grown vegetables, fruits, legumes, grains, and ornamental plants, and related products in such manner as the department head and/or governing body of the department, appointed by the City Council, deems appropriate.
  3. Research and apply organic and Vedic organic principles and practices.
  4. Collaborate with educational, governmental, non-profit and other organizations in expanding organic and Vedic organic agricultural operations in any location.

This ordinance shall be effective on April 22, 2003.
